GENERAL TERMS AND CONDITIONS

The website goodtravel.de is operated by “360 Grad Good Travel GmbH”, based in Berlin. The use of the website is subject to the following general terms and conditions:

§ 1 WEBSITE CONTENT

1. Good Travel presents on its website holiday accommodations (hotels, B&Bs, holiday houses and apartments and other accommodations intended for short-term rental) of different landlords.
2. The provider of the listed holiday accommodations is not Good Travel, but the respective hotel or the respective landlord of the holiday accommodation (hereinafter referred to as "landlord").
3. In addition to these general terms and conditions, the reservation conditions of the holiday accommodations are based on the specific conditions of the respective landlord. These are available during the reservation process. This applies in particular, but not exclusively, to the cancellation and payment conditions (including currency) as well as the use of the holiday accommodation facilities.
4. Contracts for the booking of a holiday accommodation are only concluded between the user and the landlord. Good Travel does not become a contractual partner of the user. Good Travel does not offer accommodation or travel services in its own name or in the name of others.
5. The landlord is responsible for the correctness of his object description, in particular for the correctness of the data to location, size, equipment and price. The same applies to photos, videos and other files and information provided by the landlord.
6. The user of the website declares that he is of age and legally able to accept the general terms and conditions and other terms of use of this website bindingly.
7. It is expressly forbidden to use the website for illegal purposes. This includes the modification, reproduction, copying or unauthorized distribution of the website.

§ 2 USE OF THE WEBSITE

1. The purpose of Good Travel is to inform individual travellers about interesting travel destinations and accommodation options. The data provided in the website serve exclusively for this direct, individual and own information of the respective user.
2. Any other use requires the written consent of Good Travel. Without such consent, the reproduction of information from the website elsewhere for commercial purposes, such as on other websites or in databases, is prohibited.
3. All texts, pictures, videos and other contents of the website are protected by copyright; they may only be stored on a computer, forwarded by e-mail or printed out within the scope of the purpose described in Article 2 a).
4. The use of the website is free of charge.
5. There is no claim that the website is permanently and uninterruptedly available. Good Travel reserves the right to change or remove website content at any time.

§ 3 Prices

1. The prices listed on our website are “starting from prices” and are for orientation only and do not represent guaranteed prices or concrete offers. Also the listed prices during the non-binding booking request do not represent real time prices or guaranteed prices. Binding prices are communicated to the user only after a concrete booking enquiry in the form of a binding booking offer directly from the landlord.
2. The prices in the respective national currency of the location of the holiday accommodation are decisive for the prices of the holiday accommodation. This also applies to down payments. All prices are displayed on our website in Euro. The exchange rate used here results from publicly available sources and serves only as a guide. Therefore, the actual prices of holiday accommodation in non-euro countries may differ from the Euro prices shown.
3. We make every effort to display all prices including the applicable VAT or tax type, but do not accept any responsibility for the correct presentation of the taxes of the respective country. Commercial providers of holiday accommodation in Germany are in any case obliged to communicate their prices including VAT. Other landlords can also display prices excl. VAT. The tax is always due when the payment is actually made.

§ 4 Bookings

1. The website enables the user to contact the landlord free of charge and without obligation by means of a web form ("booking request") or by forwarding to the provider's website.
2. In the case of a booking request Good Travel transmits the data of the request from the user anonymously by e-mail to the landlord of the respective holiday accommodation.
3. If the requested landlord confirms a specific reservation to the user, the user hereby submits a binding reservation order to the landlord to which he is bound. The user receives a confirmation of the reservation by e-mail. He is therefore required to provide us with his exact e-mail address. Such confirmation will normally be sent within 24 hours after you have submitted your binding reservation order. If a reservation is not accepted by the landlord, we will endeavour to offer a possible alternative. It is entirely up to the user to decide whether or not to accept it.
4. Good Travel does not become a contractual partner of the user. Also reservation agreements are concluded exclusively between user and landlord.

§ 5 Payment

1. A deposit or the deposit of credit card information is usually required for a binding reservation. This transaction does not take place on our website. Normally, full payment will be made later on site. The credit card will only be charged if the landlord requires a deposit or cancellation fees are incurred. Cancellation fees vary by hotel and are subject to the cancellation policy of each hotel.

§ 6 Cancellation

1. Each hotel has its own cancellation conditions in relation to a valid and confirmed reservation. We therefore strongly recommend that you read these cancellation conditions carefully before making a reservation. Once the reservation has been confirmed, you will be subject to these cancellation conditions.
2. All disputes regarding the cancellation of a reservation must be settled directly between you and the hotel concerned. We do not participate and cannot be held responsible. You may not make any claim against us with respect to the cancellation fees of any affected hotel, and any recourse claims should be directed to the relevant landlord.

§ 7 DISCLAIMER OF LIABILITY

1. We only act as an intermediary between you and the landlord and have no control over the quality of service and the prices and charges of the holiday accommodation. For this reason, we are not responsible and cannot be held liable for any dispute between you and the Landlord arising out of prices, fees, quality of service or furnishing of the Holiday Accommodation. The contract is concluded between you and the landlord. We therefore ask you to address any claims or complaints directly to the respective landlord. Good Travel is not liable for acts or omissions of the landlord.
2. Good Travel shall not be liable for any pecuniary or other damages unless Good Travel has caused such damages intentionally or through gross negligence. This limitation of liability does not apply in the event of injury to life, limb or health.

§ 8 MISCELLANEOUS

1. The content of our website and our services are governed exclusively by the laws of the Federal Republic of Germany.
2. If there are differences between the German version of these General Terms and Conditions and a version in another language, the German version shall prevail.
